Terms and Conditions

These Terms and Conditions (T&Cs) apply in addition to the separate Beta Terms, to which you expressly agree when activating your Beta access. In case of conflict, the Beta Terms prevail.

1. Scope

These T&Cs apply to use of the website harriet.tax as well as the Harriet web application (hereinafter "Application" or "Service"), operated by Mario Deubler, Schödlbergergasse 16/53, 1220 Vienna, Austria (hereinafter "Provider").

2. Description of the service

Harriet is a digital data preparation tool for freelancers and one-person businesses (EPU) in Austria. The Application supports the capture, categorisation and completeness check of tax-relevant receipts and the preparation of the Einnahmen-Ausgaben-Rechnung (cash-basis bookkeeping) and the E1a annex for review by an authorised tax advisory firm.

Harriet is expressly not a tax advisor and does not provide tax advice within the meaning of the Austrian Wirtschaftstreuhandberufsgesetz (WTBG 2017). The suggestions produced by the Application — in particular categorisations, optimisation hints and tax forecasts — are data preparation, not advice. Responsibility for tax accuracy, for the final review and for filing with the Finanzamt rests with you or with the tax advisory firm engaged by you.

3. Closed Beta

Harriet is currently in a closed Beta phase. Access is limited to invited users and is free of charge. The Provider may at any time change, expand, restrict or discontinue the feature scope or end the Beta. There is no claim to a particular availability, a particular feature scope, or to permanent or free use.

4. Registration and user account

Use of the Application requires registration with a valid email address. You undertake to provide truthful information and to keep your access credentials confidential. Any suspicion of misuse must be reported to us without delay.

5. User duties

You undertake to use the Application only for lawful purposes, not to upload content that violates applicable law, and to upload third-party content only where you are entitled to process it. You are responsible for the accuracy and completeness of uploaded receipts and bank data.

6. Data protection

Processing of personal data takes place in accordance with our Privacy Policy. Where you, as controller within the meaning of the GDPR, introduce personal data of your own or of others into the Application, we conclude a Data Processing Agreement (DPA) with you, to which you agree during onboarding.

7. Liability

We are liable in accordance with statutory provisions for damages resulting from injury to life, body or health, in cases of intent and gross negligence, and under the Product Liability Act. Otherwise we are liable only for breach of essential contractual obligations and limited to the foreseeable, contract-typical damage.

Liability for the tax accuracy of the categorisations, calculations and optimisation hints suggested by the Application is excluded to the extent permitted by law. Use is at your own responsibility; human review before filing with the Finanzamt is required.

8. Availability

We aim for a high level of availability but do not guarantee it. Maintenance windows and technical issues may lead to temporary restrictions. During the Beta phase, outages and changes of functionality are possible at any time.

9. Termination

You can delete your user account at any time or request deletion by email to hello@harriet.tax. We may suspend or terminate your Beta access with immediate effect in case of violations of these T&Cs or the Beta Terms.

10. Applicable law and place of jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-laws rules of private international law. Vis-à-vis consumers within the meaning of the Austrian KSchG, jurisdiction follows § 14 KSchG. Otherwise, Vienna is agreed as the place of jurisdiction.

11. Changes to the T&Cs

We may amend these T&Cs. We will notify registered users of material changes by email. Continued use after the amended T&Cs take effect constitutes consent; if you object to the change, we may end your access.
